On 24 October 2008, various news outlets, including CNN.com reported that New York's highest court upheld the eviction of Bianca Jagger (former wife of Mick Jagger of the Rolling Stones) from a rent-stabilized Manhattan apartment, concluding that foreigners on tourist visas generally cannot claim New York property as a "primary residence." The New York Rent Stabilization Code allows landlords to reclaim an apartment after the lease expires if it is not occupied as a primary residence. In his opinion, Court of Appeals Judge Robert Smith stated that, "perhaps there are cases in which a tenant could show that her principal dwelling place for immigration purposes is in one place, and her primary residence for rent regulation purposes in another, but defendant has not even tried to make such a showing," he wrote.

On 14 October 2008, USCIS update announces a final rule increasing the period of stay for TNs. It changes the initial period of admission for TN workers from one to three years.
